FRACTIONAL OWNERSHIP

Q. What is Freehold Fractional Ownership?

A. Freehold Fractional Ownership means that the purchaser of a Fraction owns a share of the freehold interest in the property in perpetuity. Such ownership interest is recorded by way of a registered title in the Land Register of Scotland. Freehold Fractional Ownership is superior to timeshare, where ownership rights typically disappear after a stipulated period, and where owners do not generally own an interest in title to the property.

Q. What share will I be purchasing?

A. Purchasers have options when considering partial ownership, including single-week ownership, a 4-week, or 1/13th ownership.

Q. When can I use or occupy the cottage?

A. Occupancy length is determined by the share amount you purchase, and designated at a pre-specified time during each season.

Q. Do prices vary amongst fractions and cottages?

A. Prices do vary based upon size, configuration, location and the specific weeks included.

Q. When do I pay for my fraction?

A. Payment of the price is made in stages as follows:

  • A non-refundable deposit of £1,000 is payable immediately upon reservation by check or credit card.
  • 20% of the purchase price, less the deposit of £1,000, is payable within 14 days of the date on which the legal pack is received by your solicitor.
  • The balance is paid on completion of the purchase.

Q. Can I take out a mortgage over my fraction?

A. Generally, banks will not make a mortgage available for a freehold fractional interest. However, we have identified a bank that can make available personal loans for purchasing a Fraction at very attractive rates for well-qualified purchasers.

Q. Can I use my own solicitor or do you provide one?

A. You are able to instruct your own solicitor, and we encourage you to do so. If you do not have a Scottish solicitor, we can provide you with details of Scottish solicitors who are familiar with this project and the legal documentation. If you elect to proceed without a solicitor (which we do not recommend), you will need to sign a waiver, and a mandate with instructions authorizing our solicitor to register your title to the fraction.

USE OF A COTTAGE

Q. How many people can occupy a cottage?

A. Each cottage has two bedrooms, each with a zipped king bed which can be separated into two twin beds. In addition, each cottage has a pull-out couch which can accommodate an additional two guests. A maximum of six persons can occupy a cottage at any one time.

Q. Are pets allowed in the cottage?

A. Pets are allowed in some cottages.  Cleaning fees may be applied.

Q. Will I need to furnish the cottage? What do I need to bring with me?

A. The cottages are furnished, and the furnishings will be maintained by management. Each cottage includes use of linens, towels and robes, typical bathroom amenities (such as soap and shampoo), plates, glassware and flatware, and cooking utensils. You will need to supply any food or drink, and other personal toiletry items.

Q. Are there private gardens with each cottage?

A. No. The cottages are situated in attractively landscaped grounds maintained for the benefit of the whole development. Guest and resident parking will be provided within the grounds.

Q. How will the cottages be maintained?

A. The cottages will have a full time, on-site staff which will be responsible for day-to-day operations and maintenance. Major refurbishments will be carried out at periodic intervals to ensure the development maintains its luxury standards.

Q. What charges will I be responsible for after I acquire the fraction?

A. An owner will be responsible for an annual maintenance charge (the Annual Estate Charge), and a weekly housekeeping charge for each week that the owner or his family or friends occupy the cottage. The Annual Estate Charge will cover costs of operation, maintenance and periodic refurbishment of the buildings and grounds. The housekeeping charge will cover the cost of daily towels and trash removal, and cleaning at the end of the week. The initial Annual Estate Charge will be £1,500 per year and the initial housekeeping charge will be £60 per week plus 20% VAT each. Owners may elect to have daily cleaning service and linen replacement, which will be available at an additional cost. Charges may change from time to time dependent on the level of relevant costs.

Q. Once I purchase the fraction will there be any charges in addition to the Annual Estate Charge?

A. Generally speaking, the only scheduled charges are the Annual Estate Charge and the housekeeping charge. In extraordinary circumstances, management will have the right to call for payment of extraordinary expenses. However, the Annual Estate Charge will include an amount to be contributed to a sinking fund to be available for regular and extraordinary repairs and maintenance, so extraordinary calls for payment are not expected.

Q. Can you arrange car rentals?

A. Arrangements for rental cars can be handled by the on-site management.

Q. What are the dining options?

A. The Village at Machrihanish Dunes features the Old Clubhouse Pub, which has just been fully renovated, and will serve a full range of pub and fine dining options. There are numerous other restaurants and public houses in Campbeltown. The management company will be able to assist with reservations. The future planned redevelopment of the adjacent Ugadale Hotel will provide a lounge and a Scottish fine dining experience. In nearby Campbeltown, the planned renovation of the Royal Hotel to its original grandeur and beyond, will include an additional first-class restaurant and a stunning new public house with outdoor seating overlooking Campbeltown Harbour.

GOLF BENEFITS

Q. As an owner, what rights do I have to play golf at Machrihanish Dunes?

A. In Phase 1, when a Fraction is purchased, the Purchaser (or, where the purchaser is multiple individuals or an entity, one identified nominee) will also receive the right to play golf at Machrihanish Dunes free of charge.

Q. What are the terms of the free golf at Machrihanish Dunes?

A. The free golf will be for the use of one named owner or nominated individual and only during the four weeks of occupancy relating to his or her Fraction. This belongs to the named owner or single nominee for their lifetime as long as he or she (or the entity) remains the owner of the Fraction.

Q. What other golf benefits at Machrihanish Dunes are provided?

A. Owners of Fractions and their guests will be entitled to preferred tee times at Machrihanish Dunes Golf Club, as well as discounted green fees.

RENTAL OF FRACTION

Q. Can I rent out unused weeks of my Fraction?

A. Yes. An owner can rent out their fraction privately or participate in a letting scheme offered by the management. Under this scheme, an owner can, on not less than nine months notice, opt into a rental arrangement for weeks during which their fraction will not be used. Any proceeds from the rental of the unit will be shared equally between the owner and management, with management’s portion being used to cover marketing, administrative and housekeeping costs.

Q. If I choose not to use a week or weeks can I allow family or friends to use the Fraction?

A. Yes. You may make any private arrangements that you choose. However, in order to maintain brand integrity, fraction letting may not be advertised or otherwise publicised.

SALE & TRANSFER OF FRACTION

Q. At some future point in time can I sell my fraction?

A. Yes. You can sell your Fraction at any time.

Q. Can I transfer ownership of my fraction to another individual?

A. Yes. Ownership can be transferred in the same way as other residential property. It can be left to an heir through a will, gifted or sold.

Q. Are there any limitations on sale?

A. There are some limitations concerning the sale process, including an obligation to first offer the Fraction back to management at your chosen price. Please review the documents in their entirety for complete details.

Q. Who is the developer of The Village at Machrihanish Dunes?

A. Kintyre Development Company Limited (KDC) is the owner of the project. The Project is managed by Southworth Europe Limited, an affiliate of Southworth Development LLC a US-based golf, resort and residential development company which has successfully served as developer, manager, consultant and/or construction manager to over 40 properties during the past 18 years through its affiliated companies.
